This one is not inscribed but it is typical of the type.<br />
The rugs as a group show a high degree of sophistication. The wool quality is high and the dye quality is exceptional. But the rug is not the product of a cartoon design, As we can see in the image directly below. Following the work of Jon Thompson we can see that the corner lacks the design resolution of the corner turn. What we have here is more kin to very high quality Tribal weaving of incredible size. This matches up with stories I head years ago that the best weavers in the tribe many of them Grandmothers would weave for the Khan.<br />

A Santa Fe couple is suing a local rug shop for allegedly losing their $30,000 Turkish rug after they took it there for repair and cleaning.<br />
<br />
Albert Robinson and Susan Stockstill say in a complaint they bought the 7-by-10-foot "Hereke Ozipek silk-on-silk carpet" from a factory in Istanbul, Turkey, in April 1997. Stockstill, a lawyer, filed the suit in state District Court last week.<br />
<br />
In March 2007, Robinson took the rug to Azhar's Oriental Rugs, 217 Galisteo St., to have it cleaned and a damaged section repaired, the complaint says. It says Robinson was told the cleaning would be $500 and the repair $750, plus the cost of shipping it to and from Turkey. He put down a $500 advance via a credit card and was told to check back on its status in July 2007, the complaint says.<br />
<br />
When Robinson returned that month, it says, a clerk could find no record of the rug and told him to return later. The complaint says when Robinson returned with a copy of his receipt, his credit card charge ticket and a color photograph of the rug, the clerk said he did not have the rug, but showed him three invoices that appeared to have forged signatures.<br />
<br />
One invoice put the value of the rug at $182,000, the repair cost at $5,280 and the cleaning cost at $750, the complaint says. It says documents shown to Robinson indicated the rug was shipped to a Houston address, and a claim had been filed with UPS for a missing rug valued at $182,000, but employees at the shop refused to allow Robinson to make copies of the documents.<br />
<br />
Messages left for the owners or manager of Azhar's Oriental Rugs this week were not answered. According to the complaint, the shop is owned by Abbasid Inc., a Texas corporation; Phoenician Imports Inc., a Florida corporation; Azhar Said; and Bina Said, also known as Bina Shahani, Bina Advani and Bina Navani.<br />
<br />
Robinson and Stockstill said they have sent Azhar's a letter demanding the return of their rug, but have yet to hear back. They say the Attorney General's Consumer Protection Division has "had no success in their efforts to mediate, and advised Plaintiffs to file suit."<br />
<br />
The complaint seeks return of the rug, damages of $30,000 — the estimated value of the rug — plus a refund of the advance payment of $500, or, in the alternative, trebled damages of $91,500.<br />

Azhar Said and Bina Shahani had an unconventional, and short, marriage. The case before us is one of the repercussions of its demise. Mr. Said was the sole officer and shareholder of Abbasid, Inc., a Texas corporation, which opened Azhar's Oriental Rugs in Santa Fe in August 2004. Shortly thereafter Ms. Shahani moved to Santa Fe, and she married Mr. Said in December. During the marriage Mr. Said was rarely in New Mexico. In his absence Ms. Shahani took on a role at the rug store, although the extent of that role was hotly disputed at trial. What is not disputed is that Ms. Shahani deposited a portion of the store's receipts—both checks and cash—in the account of her cousin, Dina Advani, at Los Alamos National Bank (the Bank) and used some money from that account for personal expenses. Mr. Said and Ms. Shahani were divorced on March 13, 2008.</div>

Abbasid's amended complaint claims conversion and negligence in accepting deposits to Ms. Advani's account. The conversion claim relies on the New Mexico Uniform Commercial Code, N.M. Stat. Ann. § 55-3-420 (1978), alleging that the Bank took checks from a person not entitled to enforce the checks or receive payment. The negligence claim alleges that the Bank injured Abbasid by failing to act with proper care in accepting Abbasid's checks for deposit or payment without Abbasid's authority. The district court dismissed the negligence claim on the grounds that the Bank owed no duty of care to Abbasid and that the claim was preempted by § 55-3-420, which imposes strict liability. After trial the jury returned a special verdict that the Bank did not convert any of Abbasid's checks.</page><br />

Abbasid filed a timely motion for new trial on March 26, 2010, and a notice of appeal three days later (our case No. 10-2069). The district court denied the new-trial motion on July 23. Abbasid filed a motion to reconsider the denial, but that was denied on August 24. On September 22 Abbasid filed an amended notice of appeal (our case No. 10-2218). We consolidated the two appeals. Abbasid's opening brief raises the following assertions of error in the decisions below: (1) the district court improperly denied its motion for new trial claiming that the verdict was against the weight of the evidence; (2) the court improperly excluded evidence of the Bank's check-handling policies; (3) the court improperly instructed the jury on mitigation of damages and improperly admitted evidence on the issue; (4) the court improperly rejected Abbasid's requested jury instruction on authority; (5) the court improperly granted the Bank summary judgment on the negligence claim; and (6) the court improperly permitted postjudgment discovery. We have jurisdiction under 28 U.S.C. § 1291 and affirm. Most of Abbasid's claims of error need not be addressed on the merits because the arguments have not been properly preserved or any error was mooted by the verdict. The remaining claims fail on the merits.</div>

Abbasid contends that the district court improperly rejected its motion asserting that the verdict was clearly against the weight of the evidence, which showed that Ms. Shahani lacked authority to use the rug store's receipts for her personal expenses. We do not review this contention, however, because Abbasid failed to raise it adequately in district court. In Abbasid's motion for a new trial the full argument on this point was:</div>

Aplt.App. at 247-48. Because this briefing was inadequate, the court requested supplemental briefing with citations to the record. But after receiving nothing further from Abbasid, the court denied the motion. It explained:</div>

On appeal Abbasid does not contend that it adequately presented its argument to the district court.<sup style="border: 0px; margin: 0px; padding: 0px;"><a class="tooltip" fid="1" href="http://www.leagle.com/decision/In%20FCO%2020120124098#fid1" style="border: 0px; margin: 0px; padding: 0px; text-decoration: none;">1</a></sup>Indeed, it does not even mention the actual ground on which the district court denied its motion. We ordinarily do not address issues not raised in the briefs, <i style="margin: 0px; padding: 0px;">see Stump v. Gates,</i> <cites style="margin: 0px; padding: 0px;"><a href="http://www.leagle.com/cite/211%20F.3d%20527" style="border: 0px; margin: 0px; padding: 0px; text-decoration: none;">211 F.3d 527</a></cites>, 533 (10th Cir.2000), and we see no reason to do so here. Accordingly, we affirm the denial of Abbasid's motion for a new trial on the unchallenged ground relied on by the district court.</div>

Abbasid contends that the district court erred in excluding evidence of the Bank's policies and procedures for handling checks. Our review of decisions excluding evidence is for abuse of discretion. <i style="margin: 0px; padding: 0px;">See Tanberg v. Sholtis,</i> <cites style="margin: 0px; padding: 0px;"><a href="http://www.leagle.com/cite/401%20F.3d%201151" style="border: 0px; margin: 0px; padding: 0px; text-decoration: none;">401 F.3d 1151</a></cites>, 1162 (10th Cir.2005).</div>

Although Abbasid asserts that the Bank's policies and procedures "are important to show how the depositor had or did not have authority to enforce the check or receive payment," Aplt. Br. at 30, this perplexing assertion is unexplained. We cannot fathom how the Bank's procedures could grant or negate Ms. Shahani's authority. The only apparent reason for admitting the evidence would be to show that the Bank failed to follow its procedures. But any such failure was irrelevant to Abbasid's strict-liability conversion claim. Abbasid's opening brief itself appears to recognize as much when it states, "[T]he negligence of either party [was] not to be considered in arriving at a verdict." <i style="margin: 0px; padding: 0px;">Id.</i> at 33. The district court did not abuse its discretion in excluding the evidence.</div>

Abbasid complains that the district court instructed the jury that the Bank's liability for damages could be reduced if Abbasid failed to mitigate its damages. But the jury was also instructed that it should not consider mitigation in assessing liability. Because the jury found the Bank not liable, the mitigation instruction could not have affected the verdict. Any error in the instruction was therefore harmless.</div>

Abbasid further contends, however, that the evidence submitted on the issue of mitigation prejudiced it on the issue of liability. But that evidence was also relevant in assessing Ms. Shahani's authority with respect to the rug store's receipts. If Mr. Said knew that Ms. Shahani was using store revenues for personal expenses yet did not stop her, one can infer that he authorized her actions. Because the evidence was admissible even if mitigation should not have been an issue, Abbasid cannot complain of the admission of the evidence.</div>

The Bank agrees that Abbasid's proposed instruction was a correct statement of the law. But a trial court need not clutter the jury instructions with every potentially relevant correct statement. <i style="margin: 0px; padding: 0px;">See Hertz v. Luzenac America, Inc.,</i> <cites style="margin: 0px; padding: 0px;"><a href="http://www.leagle.com/cite/370%20F.3d%201014" style="border: 0px; margin: 0px; padding: 0px; text-decoration: none;">370 F.3d 1014</a></cites>, 1023 (10th Cir.2004). The district court said that the proposed instruction was unnecessary because the jury instructions provided proper guidance on the application of the law. We agree. The jury was instructed that "[a] person has authority to act on behalf of a corporation when the corporation agrees by its actions to the person acting on the corporation's behalf." Aplt.App. at 230. Abbasid does not contend that this instruction was incorrect or that it was precluded from arguing to the jury that Abbasid's grant of permission to deposit checks into the rug store's account did not constitute "agreement by its actions" to deposit of the checks in Ms. Advani's account. "When the other instructions establish a sound basis for an argument by the party to the jury on [the] proposition, an additional instruction is not essential and runs the risk of suggesting that the trial judge has adopted the party's view." <i style="margin: 0px; padding: 0px;">Hertz,</i> 370 F.3d at 1023. The district court did not abuse its discretion in rejecting the instruction.</div>

Before trial the district court dismissed Abbasid's common-law claim of negligence on the grounds that it was preempted by the UCC and that the Bank owed Abbasid no duty of care. Abbasid challenges that dismissal. But we need not resolve whether a preverdict dismissal of a claim was proper if the jury's verdict on the remaining claims shows that any error in failing to present the dismissed claim to the jury was harmless. <i style="margin: 0px; padding: 0px;">See Brandt v. Wand Partners,</i> <cites style="margin: 0px; padding: 0px;"><a href="http://www.leagle.com/cite/242%20F.3d%206" style="border: 0px; margin: 0px; padding: 0px; text-decoration: none;">242 F.3d 6</a></cites>, 16 (1st Cir.2001) (Any error in dismissing claims was harmless because there was "no practical likelihood that the dismissed claim could have succeeded where the tried claim failed."); <i style="margin: 0px; padding: 0px;">Gross v. That is the situation here. The jury instructions on the conversion claim required Abbasid to prove three elements with respect to each check: (1) that Abbasid owned it; (2) that Abbasid received it either directly or through an agent; and (3) that the Bank received it for deposit from a person not authorized to enforce it or receive payment on it. The jury found that the Bank had not converted any checks, meaning that it found that there were no checks that satisfied all three elements of the conversion claim. But Abbasid's negligence claim related only to checks that satisfied those three elements. The claim was that the Bank's negligence</div>

It concerned only checks received by and owned by Abbasid that were then deposited in the Bank without authority. Because the jury found that no such checks existed, the negligence claim would necessarily fail. Thus, any error in dismissing the negligence claim turned out to be harmless.</page><br />

The Bank was awarded $5,582.85 in costs. In its efforts to collect these costs, it obtained from the magistrate judge postjudgment orders requiring Mr. Said to appear for a deposition and requiring Abbasid to respond to various interrogatories and requests for documents. The district judge affirmed the orders on January 5, 2011; and on February 2 Abbasid filed what it termed a "second amended notice of appeal" to challenge the orders. This court treated the notice as a new notice of appeal and assigned it a new case number—11-2025. Abbasid, however, did not pay the filing fee. Although we informed Abbasid that the appeal would be dismissed if the fee was not paid, it failed to make the payment, and the appeal was dismissed on April 28, 2011. Abbasid has not challenged that dismissal and cannot circumvent it by raising the postjudgment orders in this appeal, which arises out of notices of appeal (1) of the judgment on the jury verdict and (2) of the district court's order denying Abbasid's motion for a new trial. A notice of appeal of a judgment or order is not effective with respect to judgments or orders entered after the challenged judgment or order. <i style="margin: 0px; padding: 0px;">See Nolan v. Pakistan Hand knotted Carpets Exhibition 2007 was held in a surface about 3000m2 with nearly 50 stalls at the hall no.6 of Karachi Expo Center.</div>

This exhibition was inaugurated on behalf of Karachi Chamber of Commerce and Industry with participation of Pakistani manufacturers and carpet importers to other countries. "The exports of Pakistani carpets have remained stagnant for many years and are swaying around $230-250 million. This is due to the fact that only traditional markets have been tapped while there is a need to bring about a paradigm shift in the marketing, manufacturing and presentation of hand-knotted carpets from Pakistan." Said the president of Karachi Chamber of Commerce and Industry.</div>

The KCCI chief, Majyd Aziz, further added that carpet exports are less than 1.5 percent of the total exports of Pakistan, even though this industry provides livelihood to whole families rather than just individuals. He also called for setting up a state-of-the-art equipped carpet city to cater to large orders.</div>

It is noteworthy that Pakistan makes an effort to appear as a strong rival of Persian Handmade Carpets by boosting the quality of its carpets and making a variety of designs resembling the quality and variety of Persian carpets.</div>

Sadly <a href="http://www.spongobongo.com/no9993.htm">Marla Mallett</a> responded with the worst reply I have seen in the 16 years I have known her. Marla is a real expert on structure and generally an expert on Rugs and Kilims. This time Marla did not know or did not remember that the Kars region of what is now Turkey was part of Russia 100 years ago. It is not a big deal Marla is so brilliant most of the time she has earned this one. But Marla was not the one shocking in her ignorance Steve Price was.<br />

I had to read it twice to see the amazingly convoluted and incorrect point Steve was trying to make. Tabriz has been the dominant city of Persian Azerbaijan since the days of the IL-Khanid Mongols. In all that time except for a few short-lived invasions Tabriz has always been Persian. It is now the administrative center for West Azerbaijan an Iranian province. East and West Azerbaijan are part of Iran and have been for hundreds of years. The northern part of Azerbaijan was captured 200 years ago by the Russians and is now an independent country called Azerbaijan. <span style="font-family: Verdana, sans-serif;"><b>Despite what Steve Price thinks, the nation state of Azerbaijan has never ruled Tabriz.</b></span> In 1945 the Russians tried to take Tabriz but Harry Truman thwarted their plans.<br />
It is amazing how little related history and geography Professor Price has absorbed over the years. The things he writes about rugs become more explainable when you understand how very little he knows about the weavers, their location and their history.<br />

Why Paint a Rug - Painted Sarouk Rugs</h2>
In rugs for the decorative market color is everything. So what do you do if a rug is the wrong color. With Sarouk rugs they dyed them to a more saleable color. In the picture below the Painted Sarouk rug had an orange red field but was dyed to the blue/red in the image. Why? Because American homes predominantly used dark mahogany furniture and this was the color that went best with it.<br />

am not really surprised. I got that from the late <a href="http://www.spongobongo.com/zy9833.htm">Charles Grant Ellis</a>. <a href="http://www.spongobongo.com/zy9833.htm">CharlieEllis</a> was the great Oriental Rug Expert of the 2<sup>nd</sup> half of the 20<sup>th</sup>
century. Charlie used Tappet in the footnotes of one of his books. In Ellis’
work the text was pretty good but all the real meat was in the footnotes. <o:p></o:p></span></div>

It is an old fashioned and fairly obscure expression but it was many years ago that I wrote that and it was what I was thinking at the time. Think of each finger of the Barmak as a tappet.</span></span></div>

5 sided or peaked element that is used like a row of tiny yurts to frame the

"It's gorgeous," said Andrews, who lives in Mooresville. "It hadn't been cleaned in so many years."<br />
Valuable handmade rugs should be cleaned only as needed, and it's best to have a professional do the job.<br />
"A rug can cost several hundred dollars or tens of thousands of dollars," said Jeff Hendricks, owner of Smith-Mathis, a cleaning services company in Fishers. "Even a rug that's only a few hundred dollars, you don't want to replace it. You want to get good use out of it. It's something you don't want to clean improperly and ruin the value."<br />
Typically made of wool, silk, rayon, cotton or a blend of non-synthetic fibers, Oriental rugs vary widely in the materials and dyes used to make them, so they respond differently to various cleaning methods. Never entrust a high-end rug to just anyone for cleaning. A professional should test the rug to ensure the proper method is used in its cleaning.<br />
"The rugs we get in here are from all over the world," said Scott Simmons, general manager of Heirloom Oriental Rug Cleaning in Indianapolis. "A lot of the rugs we clean are quite old. So significant care has to be taken with how you clean them."<br />
Simmons recalled a situation in which one customer attempted to shampoo an Oriental rug on his own. The colors from the maroon rug faded onto the homeowner's off-white carpet.<br />
"He didn't have the knowledge to clean it to keep that from happening," Simmons said. "We incorporate the right type of chemistry to prevent color run and bleeding."<br />
A professional cleaning can cost between $200 and $600, depending on the type of rug and the work being done. Repairs also can be made to most rugs.<br />
Hendricks offers recommendations for maintaining an Oriental rug, including vacuuming it frequently and rotating it regularly so it wears evenly.<br />
"A rug that's in a high-traffic area needs to be cleaned a lot more than a rug in a room that just gets occasional use," Hendricks said. "A valuable rug probably should not be used close to the entry of the home, because a lot of chemicals -- especially salt or outdoor solvents -- can get on the rug. It's usually good to have a mat under the rug. That keeps it in place, so it doesn't move around a lot. It will last longer."<br />
Simmons said he's tackled about every type of stain, from pet damage to a family's rug collection that was heavily soot-damaged from a fire.<br />
"You can imagine the odor," Simmons said. "The rugs were almost completely black, but we were able to fully restore those."<br />
Though Oriental rugs can range widely in value, it's often the personal attachment the owners have that matters most.<br />
"A lot of the rugs that come in here have a story behind them," Simmons said.<br />
"One customer told me her kids used to use the borders as a racecar track. No two rugs are exactly the same.<br />
